What is the tenant eviction process?

In England, there are two ways to proceed with an eviction notice:

Section 8: This is used if there is a tenant and landlord dispute and the tenant has breached their contract terms. This could include property damage and antisocial behaviour.

Section 21: This is used if you want to take back possession of your property after a fixed-term contract comes to an end.

These can include speaking directly to your tenant, suggesting a temporary rent reduction if they're unable to afford the full amount or allowing them to find a new rental property. If these options are not feasible or you've already exhausted these avenues, the next step might be to begin eviction proceedings.

It's illegal to immediately evict any tenant without a formal court order. A Section 21 eviction notice can be presented in writing once a fixed-term contract ends but a landlord must give two months' notice. In this situation, no information needs to be given as to the reason for the eviction. In many cases, this is presented when a landlord wishes to repossess or sell their property.
