<h3>Changes brought by last year’s Leasehold Reform</h3>

<P>This new ban could help buyers find their perfect leasehold home in London’s incredible new-build market. But, of course, there is the matter of existing leasehold property. 
<p>Last year, right before the Conservatives left office, they pushed through a number of bills. Leasehold Reform was one of them, which made some strides in the ownership of existing leasehold properties. 
<P>The roll out has been a little trickier. The new government have said that some aspects of the bill require further consultations and secondary regulations. So, here’s what has changed and what has yet to change:

<h3>Still to come</h3>
<p>The biggest issue still to be ironed out is ground rents for <b>existing</b> properties. So far: 
<p style="margin-left: 25px">&#x2022	The <b>Leasehold Reform Act 2022</b> banned ground rents for most new residential property, but that does not apply to leases granted before 30 June 2022. 
<p style="margin-left: 25px">&#x2022 To pass the <b>2024 Leasehold Reform Act</b> quickly, the proposed cap on ground rent for existing property was scrapped. 
<p style="margin-left: 25px">&#x2022 This new <b>2025 Leasehold Ban</b> also wouldn’t address ground rent in existing leases, so there is still room for improvement. 
This is a complex bit of legislation to get through, but it would make a property into a more attractive listing, helping a lot of London’s homeowners move more quickly.

This Valentine's Day, we're playing Cupid for London properties and the timing couldn't be better. <a href='https://www.rightmove.co.uk/press-centre/february-march-are-the-best-months-to-list-a-home-for-sale/' target='_blank'>Rightmove's latest study</a> says nearly 7 out of 10 properties listed in February go on to complete.</h2>

<h3>Why are buyers so fond of February?</h3>
<p><a href='https://www.rightmove.co.uk/press-centre/february-march-are-the-best-months-to-list-a-home-for-sale/' target='_blank'>Rightmove's data</a> shows February isn't just for romance – it's also the best time to list a property. 
<p>Analysing sales from 2012 to 2023, the study showed January and February to be the two months when a new property listing will find a buyer fastest - just 51 days. Meanwhile, nearly seven in 10 homes (66.3%) listed in February and March went on to complete as a successful sale. So it turns out, <b>February is the sweet spot</b>.

<p>Just yesterday, we shared the exciting news of <b><a href='https://www.foxtons.co.uk/discover/2025/02/mortgage-rates-below-4-are-back-is-it-time-to-buy' target='_blank'>mortgage rates dipping below 4%</a>.</b>  This is a significant milestone for buyers, and as an industry expert at Alexander Hall mortgage brokers put it, it's broken that "psychological barrier" that's been keeping some buyers on the fence.  They're seeing this positive shift firsthand in their clients, and we're seeing it too.

<h3>What's changed?</h3>
<p>The Bank of England recently lowered the Base Rate, which is usually good news.  However, this time around, the excitement was muted because they also pulled back on their predictions for economic growth in 2025. <p> Despite this cautious outlook from the Bank of England, we're happy to report that the property market remains positive. In fact, some mortgage lenders are offering some of their best rates in months, and even <i>years</i>.  This positive shift in lender confidence is a welcome development. </p>

<a id="whats-available"></a><h3>Can I get a mortgage rate under 4% now?</h3>
<p>Our partner broker, <a href='https://www.alexanderhall.co.uk/' target='_blank'>Alexander Hall</a>, tells us that there are both 5-year and 2-year fixed rate products below 4% once again. While we saw some 5-year fixed deals <a href='https://www.foxtons.co.uk/discover/2024/01/rates-fall-doors-open-more-good-news-for-buyers-and-landlords' target='_blank'>below 4% last year</a>, this is the first time since March 2023 that 2-year fixed rates have been this low.
<p>This means you could get a mortgage with lower monthly payments than you might have expected. Alexander Hall works with both high street banks and specialist lenders to find the right mortgage for you.

<p>All this fuss over less than a 1% decrease? You'd be surprised; a small change in your mortgage rate can actually make a huge difference to your monthly payments. Even a quarter of a percent (0.25%) drop could save you hundreds of pounds each year:

<p>Many people who bought through us when rates dipped this time last year are now happily settled in their new homes with 2-year or 5-year fixed rates. However, no one can perfectly time the market to get the lowest possible rate. 
<p>As we said last year: "Rates might come down a bit more, or they might not. Is waiting for a possible better deal worth missing out on what's available now? Only you, your adviser and time will tell."

<p>If you're thinking of getting a fixed-rate mortgage, here are a few things to consider:

<p style="margin-left: 25px">• A 5-year fixed rate will give you peace of mind on your monthly payments, however we may see rates fall further over the coming years. In which case, a shorter-term deal could give you the flexibility to switch in 2-3 years.

  <p>GA: The Renters' Rights Bill has just cleared its second reading in the House of Lords, and while the core legislation hasn’t changed, the debates have revealed some crucial concerns for London's property market. Let's break down the key issues that every landlord needs to understand.

<p>The late addition of a ban on upfront payments has sparked intense debate. There are 3 million people renting in London and we see 10-15% of tenants using upfront payments – the self-employed, international students and those with poor credit history or fall just short of affordability checks. And in such a competitive market, this ban could significantly impact housing accessibility for these groups. It deserves further consideration. We see over 16 applicants vie for each property, so the government should understand that it will affect these groups more than landlords who can rent to the remaining 80%. 

<p>FG: Despite the Government’s assurances that they are collaborating with the Ministry of Justice, the Lords’ concerns about court system capacity remain valid. Our advice? Focus on what you can control. Thorough documentation and proper pre-tenancy procedures are crucial as they have always been. Remember, our property management and credit control teams are trained to handle complex situations as and when they arise.

<p>The extension of the Decent Homes Standard to private rentals is an important step forward we support. <p>While we fully support the bill's objectives to protect tenants, success will lie in the details. <p>I am writing this letter to you in my capacity as Chief Executive Officer of Foxtons Group plc, London's largest lettings agent, to express concern over the late changes tabled during the Renters' Rights Bill's second reading, specifically regarding the <b>banning of upfront rental payments and the lack of a sufficient transition period.</b>

<p>We want to make it clear that we are wholly supportive of your government's efforts, and indeed previous government efforts, to improve living conditions across the entire sector and to ensure the rental market works for everyone. 

<p>But while we support the overarching goals of the proposed legislation, we believe that these amendments will unintentionally harm lower-income tenants, the international student market, hinder upward mobility, and drive talented individuals away from London and the UK. 

<p><b>The problem and the unintended consequences</b>
<p>Landlords typically ask for rent in advance from tenants who struggle to pass traditional affordability checks, such as those with low or unpredictable income, the self-employed, pensioners and foreign tenants who cannot provide a guarantor. Our data highlights the scale of this issue: 10-15% of tenants narrowly fail affordability criteria. 

<p>The impact of removing upfront payments would therefore be most pronounced for lower-income tenants, many of whom currently rely on savings or guarantors to secure housing. These individuals would be left with no viable alternatives, effectively excluding them from the rental market and exacerbating the very issues the reforms seek to solve. 

<p><b>Hindering upward mobility</b>
<p>Restricting access to housing in this way also risks undermining social mobility and deterring people from relocating to cities like London - particularly students and entry-level professionals. This could result in a 'talent drain', leaving London and other major cities struggling to attract and retain the diverse, skilled workforce needed to drive innovation and growth. At a time when economic growth is critical, such a loss of talent could have long-term consequences on local economies. 

<p><b>The landlord impact</b>
<p>These regulations would also have an impact on landlords. Upfront payments help mitigate the risk of missed payments from those tenants who can sustain a tenancy but who are unable to pass referencing and affordability checks - without these upfront payments, landlords are understandably less likely to rent to such tenants. It is impractical and irresponsible to deny landlords any assurance when renting to individuals who cannot easily prove their financial capability. This could exacerbate challenges in an already constrained market and may reduce the supply of rental homes, drive up rent prices, and make affordable housing harder to find.

<p><b>Lack of a sufficient transition period</b>
<p>We are also seriously concerned about the proposed two to three-month transition period, which is entirely inadequate for implementing these changes effectively. Such a short timeframe fails to provide tenants and landlords with sufficient time to adapt, potentially leaving vulnerable tenants without stable accommodation in an already challenging market. The lettings sector is complex and fragmented. Software systems (typically administered by third parties) will need time to re-engineer. The retraining of lettings agents and property managers takes time. We strongly believe that no less than six months' notice should be given between Royal Assent and the commencement date. This will afford landlords and letting agents sufficient time to implement the necessary regulatory changes in an orderly manner, ensuring a consistent and fair approach for tenants seeking rented accommodation. 

<p><b>It doesn't fix the real issue</b>
<p>Foxtons supports the vision of a fair and sustainable rental market that works for everyone. However, these last-minute amendments fail to address the real issue: the chronic undersupply of housing and the resulting supply/demand imbalance. Instead, they risk creating unintended consequences that make the rental market even more challenging for lower-income tenants. 

<p>At a minimum, it is essential for the government to address this question: how can those who narrowly miss affordability criteria overcome the barriers to housing these changes will create? Without a clear answer, achieving a fair lettings market for tenants will remain out of reach. 

<p>We would welcome the opportunity to meet with you to discuss how we can support the government in creating a balanced and sustainable plan that benefits lower income tenants and reduces the risk of landlords withdrawing from the rental market.

<h2 class='intro_basic'>Nationwide’s new <a href='https://www.nationwidehousepriceindex.co.uk/reports/affordability-stretched-but-gradually-improving' target='_blank'>Housing Affordability Report</a> reveals that affordability has improved for house buyers across the country.</h2>
<p>Straight away, we should say that this is not a sweeping surge in affordability where every mortgage application breezes through. Affordability is still stretched, particularly in London. There is, however, huge potential in a market like this, if you know where to look.
<p>Foxtons CEO Guy Gittins says, “In fact, we’ve actually seen mortgage approval levels climb by 31% in the last 12 months versus the 12 months prior. At the same time, there’s been some 3.4% more homes sold across the UK market, with over one million transactions taking place over the last 12 months.”

<h3>What improved affordability looks like in London</h3>
<p>While London saw the greatest improvement to affordability of any region, it’s still home to the highest house prices. That’s life in the big city – and it’s also a big reason people rate property ownership here so highly.

<p>Guy Gittins comments, “In recent years the property market has performed well in the face of economic uncertainty and, even with higher interest rates and the resulting increase to mortgage rates, we are yet to see the appetite of the nation’s homebuyers dampened.”


<h3>Why has affordability improved?</h3>
<p>Across the UK, the first reason behind affordability’s improvement is that the average growth in earnings is slightly higher than house price growth, giving homeowners more breathing room around those monthly outgoings.

<p>The other reason, which we’ve found particularly motivated our buyers as of late, is that borrowing costs began to come down in 2024. <a href='https://www.foxtons.co.uk/discover/2024/11/news-of-interest-rate-cuts-spark-further-wave-of-homebuyer-excitement' target='_blank'>As we predicted it might</a>, sentiment has improved for lenders. This means the market carries less risk, which can benefit the amount of mortgages lenders offer and approve.

<h3>What’s going to happen to affordability in 2025?</h3>

<p>Andrew Harvey, Senior Economist at Nationwide, thinks this momentum will keep things moving in the right direction for the UK, “Providing the economy recovers steadily, as we expect, the underlying pace of housing market activity is likely to continue to strengthen gradually as affordability constraints ease through a combination of modestly lower interest rates and earnings outpacing house price growth.”

<p>Guy Gittins weighs in with the London analysis: “We currently expect 2025 to bring more of the same and, certainly across the London market, we’ve seen a flurry of buyer activity already this year."

<p>Even with increased Employer National Insurance costs, confidence is a powerful factor in the capital. <h3>Stamp Duty changes: what you need to know</h3>
<p>1 April isn't fooling around. That's when stamp duty rates snap back to their old ways, meaning you'll pay at least 2% tax on anything above £125,000, increasing in the bands you'll find in the chart below.

<p>For first-time buyers, it's an even bigger deal – your tax-free threshold drops from £425,000 to £300,000. Also, the maximum property value you can buy and still claim relief drops from £625,000 to £500,000. That extra £125,000 on the property price is a huge advantage when you’re trying to buy in London.

<p>But the real story of 2024 has been the <b>mortgage market</b>. <p><a href='https://www.foxtons.co.uk/discover/2024/11/news-of-interest-rate-cuts-spark-further-wave-of-homebuyer-excitement' target='_blank'>Rates have started to fall</a> as the base rate improved. In August 2024, it fell to 5%, and in November to 4.75%. However, affordability is still the key issue, and will remain that way in 2025.
<p>So, we've been genuinely impressed by how lenders have stepped up their game. They've gotten creative with their products, making homeownership more accessible for first-time buyers and ambitious movers. This innovation will be crucial as we head into 2025.

<p>Remember the ultra-low pandemic-era base rate? Five years ago, it reached a historic 0.1%, which is, frankly, hard to imagine these days. 

<p>When rates began to rise, there was a transition period. It was a bit rocky while buyers and sellers faced the market with different price expectations. But by now, we are all well-adjusted to the new normal. Buyers, sellers, agents, lenders – everyone's expectations are now much better aligned. 

<P>Why does that matter? Well, with inflation cooling and wages growing,* we're seeing improved sentiment across the market. That can lead to banks being less risk adverse with mortgage applications as well as a more active market, with the opportunities to achieve your property goals.
