<p>The law in relation to material information and misdescription is currently contained in the Consumer Protection from Unfair Trading Regulations 2008 (CPRs). However, in April this year, these are set to be revoked and replaced with Part 4 of the Digital Markets, Competition and Consumers Act 2024.

<a id="section2"></a>
<p>The CPRs have long regulated property listings and descriptions. They include omissions and misstatements that adversely affect the ‘transactional decision’ of the average consumer. A breach of the CPRs is what is known as a ‘strict liability’ offence. This is a special type of liability whereby an offence is committed regardless of whether the agent intended to commit one or not. What this means is that innocent mistakes are punishable in the same way as intentional or reckless ones.

<p>There is not a huge amount of difference between the new requirements and the existing CPRs. Fundamentally, the law will still prohibit what it terms ‘unfair commercial practices’. However, read literally at least, the new act carries a broader definition of this term in so far as this will now include omitting material information from an invitation to purchase.

<p>This doesn’t seem that significant until one considers that the meaning of invitation to purchase generally means an advert selling (and describing) something. A property listing, for example, is an invitation to purchase. This new element then means that anything that contravenes the requirements of due diligence or leaves out material information from the advert could be upheld as an unfair commercial practice. Put simply, things still have to be described very accurately and fully.

<p>In November 2023, National Trading Standards published updated guidance on material information requirements for sales and lettings. The requirements contain in-depth and technical information about elements of a property that, in fact, few owners or leaseholders could necessarily be expected to know. For example, details about restrictive covenants or easements over the property. 

<p>Traditionally, these have been matters of title that are explored and clarified during the conveyancing stage of a property transaction by the purchaser’s solicitor. They are not matters that can readily be understood by the average lay vendor. This makes them difficult to accurately describe and insert into a property advertisement by agents who are not legally qualified, which creates a greater risk of misdescription.

<p>At the heart of all this is the theory that providing more detailed information within the property listing will make the process of buying and selling an easier and more transparent process for both sides. In one sense that is true: information a buyer can see early on is clearly a good idea.

<p>On the flip side, however, is that the information is legalistic (therefore difficult to understand) and descriptive. A buyer’s solicitor is unlikely to advise their client to rely on such information (generated as is by the vendor) and will instead likely commission their own searches on which they can more comfortably advise their client as to whether to proceed or not with the transaction.

<p>The proptech market has been quick to move into this area. Several companies now exist who can – impressively – collect this information for agents and load it into listings. Even so, not all the information can be collected because some things are known only to a vendor (or landlord).

<p>And if the purpose of the whole process is to speed things up, can it really be said this will be achieved if naturally circumspect purchasers, owed no duty of care by the vendors or their agents, are best advised to run their usual searches (at cost) anyway?

<p>At best, there’s likely to be a duplication of information. Buyers will likely still engage their own solicitors to advise them about the property and be naturally reticent to rely on information provided by a vendor or the vendor’s agent.

<p>The guidance is just that: guidance. And the new law arguably doesn’t change that much when you consider that the CPRs apply to property listings. So the changes may mean relatively little right now, but it remains to be seen how they will be interpreted by the courts, who are the ultimate arbiters in cases of dispute.

<P>This new ban could help buyers find their perfect leasehold home in London’s incredible new-build market. But, of course, there is the matter of existing leasehold property. 
<p>Last year, right before the Conservatives left office, they pushed through a number of bills. Leasehold Reform was one of them, which made some strides in the ownership of existing leasehold properties. 
<P>The roll out has been a little trickier. The new government have said that some aspects of the bill require further consultations and secondary regulations. So, here’s what has changed and what has yet to change:

<h3>Still to come</h3>
<p>The biggest issue still to be ironed out is ground rents for <b>existing</b> properties. So far: 
<p style="margin-left: 25px">&#x2022	The <b>Leasehold Reform Act 2022</b> banned ground rents for most new residential property, but that does not apply to leases granted before 30 June 2022. 
<p style="margin-left: 25px">&#x2022 To pass the <b>2024 Leasehold Reform Act</b> quickly, the proposed cap on ground rent for existing property was scrapped. 
<p style="margin-left: 25px">&#x2022 This new <b>2025 Leasehold Ban</b> also wouldn’t address ground rent in existing leases, so there is still room for improvement. 
This is a complex bit of legislation to get through, but it would make a property into a more attractive listing, helping a lot of London’s homeowners move more quickly.

<h2 class='intro_basic'>Nationwide’s new <a href='https://www.nationwidehousepriceindex.co.uk/reports/affordability-stretched-but-gradually-improving' target='_blank'>Housing Affordability Report</a> reveals that affordability has improved for house buyers across the country.</h2>
<p>Straight away, we should say that this is not a sweeping surge in affordability where every mortgage application breezes through. Affordability is still stretched, particularly in London. There is, however, huge potential in a market like this, if you know where to look.
<p>Foxtons CEO Guy Gittins says, “In fact, we’ve actually seen mortgage approval levels climb by 31% in the last 12 months versus the 12 months prior. At the same time, there’s been some 3.4% more homes sold across the UK market, with over one million transactions taking place over the last 12 months.”

<h3>What improved affordability looks like in London</h3>
<p>While London saw the greatest improvement to affordability of any region, it’s still home to the highest house prices. That’s life in the big city – and it’s also a big reason people rate property ownership here so highly.

<p>Guy Gittins comments, “In recent years the property market has performed well in the face of economic uncertainty and, even with higher interest rates and the resulting increase to mortgage rates, we are yet to see the appetite of the nation’s homebuyers dampened.”


<h3>Why has affordability improved?</h3>
<p>Across the UK, the first reason behind affordability’s improvement is that the average growth in earnings is slightly higher than house price growth, giving homeowners more breathing room around those monthly outgoings.

<p>The other reason, which we’ve found particularly motivated our buyers as of late, is that borrowing costs began to come down in 2024. <a href='https://www.foxtons.co.uk/discover/2024/11/news-of-interest-rate-cuts-spark-further-wave-of-homebuyer-excitement' target='_blank'>As we predicted it might</a>, sentiment has improved for lenders. This means the market carries less risk, which can benefit the amount of mortgages lenders offer and approve.

<h3>What’s going to happen to affordability in 2025?</h3>

<p>Andrew Harvey, Senior Economist at Nationwide, thinks this momentum will keep things moving in the right direction for the UK, “Providing the economy recovers steadily, as we expect, the underlying pace of housing market activity is likely to continue to strengthen gradually as affordability constraints ease through a combination of modestly lower interest rates and earnings outpacing house price growth.”

<p>Guy Gittins weighs in with the London analysis: “We currently expect 2025 to bring more of the same and, certainly across the London market, we’ve seen a flurry of buyer activity already this year."

In August 2024, it fell to 5%, and in November to 4.75%. However, affordability is still the key issue, and will remain that way in 2025.
<p>So, we've been genuinely impressed by how lenders have stepped up their game. They've gotten creative with their products, making homeownership more accessible for first-time buyers and ambitious movers. This innovation will be crucial as we head into 2025.

<p>Remember the ultra-low pandemic-era base rate? Five years ago, it reached a historic 0.1%, which is, frankly, hard to imagine these days. 

<p>When rates began to rise, there was a transition period. It was a bit rocky while buyers and sellers faced the market with different price expectations. But by now, we are all well-adjusted to the new normal. Buyers, sellers, agents, lenders – everyone's expectations are now much better aligned. 

<P>Why does that matter? Well, with inflation cooling and wages growing,* we're seeing improved sentiment across the market. That can lead to banks being less risk adverse with mortgage applications as well as a more active market, with the opportunities to achieve your property goals.

<p>We recommend our sellers already have the following list squared away before they reach this stage. So if you don’t have them yet, you know where to begin:</p>

<p style = "margin-left: 25px">• <b>Inform your mortgage provider</b> – if you have a mortgage, inform your mortgage provider of your plans.   <h3>Hit the ground running</h3>
  <P>Your buyer will submit their mortgage application, request their solicitor to start searches and arrange any surveys.
<p>You'll need to:

  <h3>The paperwork stage</h3>
  <P>The buyer’s solicitor is now conducting searches – Local Authority searches, Water and Drainage Searches, Land Registry searches and more – and reviewing all the paperwork you’ve gathered. Your solicitor helps them with their queries. 
<p>This stage tends to take around 12-20 weeks, but it can vary – shorter if you and your buyer are completely prepared, or longer if the solicitors hit a snag.

<h3>Make it official</h3>
  
<p>Your solicitor will set up a draft contract, which the buyer and their solicitor will review. Then you'll see an edited draft. Once everyone’s happy, you sign on the dotted line. 
<p>Your buyer will put down their deposit, and the completion date will be set.</p>

  <p>By midday of your completion day, you’ll need to move out of the property.  
<p>Be prepared and contactable, in case there are any delays in the purchase funds or missing bank deadlines – generally this won’t happen, but if it does, we’ll walk you through it.

<p>While the solicitors work, it’s a bit of a waiting game for you. Here’s what you can do to keep the process going smoothly: 
<p style= "margin-left: 25px">1.  When you receive questions or requests for more information, respond quickly and communicate clearly. If you’re unsure, ask us – we’ve seen it all.
<p style= "margin-left: 25px">2. From time to time, there are snags - the survey turns up something you didn’t anticipate, the local authority is delayed, the buyer’s own sale stalls. <br>You may need patience, or you might have to make some quick decisions – but you're not alone. We’ve seen everything that can happen in a sale, and can give you reliable expert insight. 
<p style= "margin-left: 25px">3. If you’re a buyer too, you’ll be busy on the other end of a transaction. Keep your purchase going smoothly with careful planning and clear communication, so you’re ready to put down the deposit on your new home when it comes through from your sale.
